Description

"Refusal of expropriation" (LIST OF REGISTERED ENVIRONMENTAL AND SOCIAL COMPLAINTS (2017-23), 23/11/2020: https://www.afd.fr/sites/afd/files/2024-04-02-02-02/AFD%20-%20liste-reclamations-sociales-environnementales%202023%20AN%20VF.pdf) "An individual filed a complaint in November 2020 concerning a project to improve drinking water infrastructure in Mersin, Turkey. The complaint denounced the expropriation of the complainant’s land. An admissibility review was conducted by an independent expert and recommended that the complaint be considered inadmissible. This recommendation was endorsed by the Mechanism’s Admissibility Committee." (2020 Activity Report, pg 7: https://www.afd.fr/en/ressources/environmental-and-social-complaints-mechanism-2020-activity-report) "The complaint was filed by the daughter of a person impacted by the project designed to improve drinking water infrastructure. In her complaint, the complainant refused to be expropriated and demanded that the project avoid her mother’s agricultural parcel. The contracting authority had informed the complainant of her expropriation and proposed to negotiate. Several alternatives were proposed after the project-affected person refused to cede part of her land. Following this, and in accordance with the country’s regulations, a declaration of public interest had been issued. A judicial procedure had fixed the amount compensating the expropriation and had authorised the contracting authority to implement the project."
